1. Acceptance of Terms
By using AuVoIP’s services, you agree to these Terms & Conditions. We reserve the right to modify them at any time with 30 days’ notice uploaded to our website.
2. Service Provision
- Services are offered on a pre-pay, monthly-in-advance basis for fixed plans, and pay-as-you-go for usage-based charges
- We may refuse or suspend service based on credit checks, misuse, or system integrity concerns.
3. Performance & Limitations
- You will be billed monthly in advance for plans and on a pay-as-you-go basis for other charges. Our current hourly support rate is $180 per hour.
- Our VoIP service operates on a best-efforts basis and may not guarantee the same reliability as traditional phone services
- Emergency calls (000) cannot be guaranteed, and functionality may be limited during power or internet outages .
- Some devices (fax, alarm systems) may be incompatible with VoIP networks.
4. Charges & Billing
- Charges include plan fees, usage, setup fees, reconnection fees, and late payment interest. All amounts exclude GST
- Your service may be suspended or terminated without notice for non-payment or abuse, but charges continue to accrue
- Inactive accounts may be closed after 6 months of non-use, with remaining credit forfeited accordconnect.com.au.
- Billing Disputes: If you wish to dispute a charge, you must notify us in writing within 30 days of the charge. No refunds will be given for unused credit balances.
- Company Accounts: If the account is registered under a company name, all directors are jointly and severally liable for any outstanding balances
- Late Payment Interest: We may charge interest on overdue balances at a rate of 2.5% per month, accruing daily. You are responsible for any legal or collection costs incurred.
- Reconnection Fee: A fee of $20 per service may apply if your service is reconnected after suspension for non-payment.
5. Equipment & Compatibility
- Customers must ensure equipment is compatible and compliant with Australian standards
- Purchased or hired hardware remains our property until fully paid. Risk transfers upon delivery .
6. Liability & Warranties
- Except as required by law, AuVoIP does not guarantee continuous operation of the service and disclaims all implied warranties (e.g., merchantability, fitness)
- We are not liable for any loss, indirect or incidental damages such as business interruption, lost profits, or data loss.
7. Customer Obligations
- You agree to use services lawfully and ethically. Misuse (spam, fraud, harassment) may result in termination .
- You are responsible for safeguarding passwords and any charges incurred through your use.
8. Variation & Termination
- We may vary service terms or pricing with 30 days’ notice. If changes are adverse, you may terminate without fees
- Termination requires 30 days’ written notice. We may immediately suspend service for serious breaches .
9. Disputes & Complaints
- For billing disputes, contact us within 30 days. Unresolved disputes can be escalated to the Telecommunications Industry Ombudsman.
- We strive to resolve disputes promptly, in accordance with Australian consumer law.
10. Governing Law
- These Terms are governed by the laws of New South Wales, Australia. Any legal claims must be heard in NSW courts.
- You may not transfer your rights under this Agreement. We may transfer our rights to a third party.
- Failure to enforce any part of these Terms does not waive our right to enforce them later.
11. Privacy
We comply with the Privacy Act 1988 (including APPs). Our Privacy Policy is available at /privacy-policy

12. Indemnity
You agree to indemnify and hold AuVoIP harmless from any losses, damages, liabilities, or legal fees arising from your use of our services, or breach of these Terms
